Terms of Service
Welcome to vayaSupa. These Terms of Service govern your access to and use of the vayaSupa website, mobile applications, driver tools, support channels, payment services, delivery services, and related features. vayaSupa is operated by YM3B9860 (PTY) LTD.
These terms apply to customers who request fuel delivery and to drivers who register for or provide delivery services through vayaSupa. By creating an account, accepting these terms in the app, placing an order, accepting a delivery request, or otherwise using our services, you agree to be bound by these terms.
1. Eligibility and Accounts
1.1 General account requirements
You must provide accurate, current, and complete information when creating or updating your account, including your name, email address, phone number, role, and any required address, vehicle, or billing details. You are responsible for keeping your login credentials confidential and for all activity under your account.
1.2 Customer eligibility
Customers must be legally able to request fuel delivery services in South Africa and must provide a valid delivery location where fuel can be safely delivered.
1.3 Driver eligibility
Drivers must be legally permitted to drive and provide delivery services in South Africa. Driver registration may require a driver's license number, vehicle make and model, vehicle license plate, vehicle color, proof of identity, proof of address, banking details, insurance or roadworthy documents, and any other information needed for safety, payment, compliance, or verification.
2. Description of the Service
vayaSupa connects customers who need fuel delivered with drivers who can complete fuel deliveries. The service may include customer and driver registration, address management, fuel order placement, fuel type and quantity selection, delivery assignment, location-based delivery tracking, order status updates, in-app or browser-based payments, cash payment workflows, notifications, invoices or receipts, and customer support.
3. Customer Orders
3.1 Placing orders
Customers are responsible for checking all order details before submitting an order, including fuel type, quantity, delivery address, contact details, and payment method. Orders are subject to service availability, driver availability, payment authorization, stock availability, weather, safety conditions, and operational constraints.
3.2 Delivery location and access
You must provide a safe, lawful, and accessible delivery location. You must be available, or ensure an authorized person is available, at the delivery location to receive the delivery and cooperate with the driver. We may refuse, postpone, or cancel a delivery if the location is unsafe, restricted, inaccurate, or inaccessible.
3.3 Order changes and cancellations
Order changes or cancellations may be limited once a driver has accepted the order, payment processing has started, the driver is en route, or fuel has been dispensed or prepared. Refunds, reversals, or credits are handled according to the payment method used, order status, and applicable law.
4. Pricing and Payment
Prices are displayed in South African Rand (ZAR) unless stated otherwise. The total payable amount may include fuel cost, delivery fees, service fees, taxes, payment processing fees, discounts, credits, or adjustments shown at checkout. Prices may change based on fuel price changes, delivery distance, operational costs, or promotions.
vayaSupa may support payment methods such as card or online payments through payment partners, Yoco checkout, saved payment methods, and cash on delivery where available. By choosing a payment method, you authorize us and our payment partners to process the payment, verify payment status, store payment references or tokens where supported, and update your order or payment records.
5. Delivery, Safety, and Fuel Handling
Fuel delivery involves regulated and potentially hazardous materials. Customers and drivers must follow all applicable safety instructions, laws, and site rules. Drivers must use appropriate care when transporting, handling, and dispensing fuel and must not complete deliveries in unsafe conditions, near open flames, while impaired, or where fuel handling would breach applicable law.
Delivery times shown in the app or on the website are estimates only. Delays may occur due to traffic, weather, driver availability, payment verification, customer availability, safety checks, or other circumstances outside our control.
6. Driver Terms
6.1 Driver responsibilities
Drivers must maintain professional conduct, follow traffic laws and safety regulations, keep their vehicle in safe and lawful operating condition, provide accurate delivery information, communicate respectfully with customers and support, and complete accepted deliveries with reasonable care.
6.2 Availability and acceptance
Drivers control when they make themselves available in the app, but once a delivery is accepted they must make reasonable efforts to complete it safely and promptly. Repeated cancellations, failure to respond, inaccurate status updates, or failure to meet service standards may result in account review, suspension, or termination.
6.3 Driver payments and taxes
Driver earnings, delivery fees, bonuses, adjustments, payment timing, and deductions may be shown in the app or communicated by vayaSupa. Drivers are responsible for their own tax obligations, business records, and any costs associated with providing delivery services unless expressly agreed otherwise in writing.
6.4 Driver compliance
Drivers must maintain all licenses, permits, insurance, safety equipment, vehicle documents, and legal authorizations required for the services they provide. vayaSupa may request updated documents, verification, or safety checks at any time.
7. Prohibited Conduct
You agree not to:
- Use vayaSupa for illegal, unsafe, fraudulent, abusive, or unauthorized purposes.
- Provide false, misleading, incomplete, or outdated account, order, driver, vehicle, location, or payment information.
- Harass, threaten, discriminate against, or abuse customers, drivers, support staff, or third parties.
- Interfere with, reverse engineer, overload, scrape, or attempt to bypass the app, website, payment systems, security controls, or platform restrictions.
- Share account credentials, impersonate another person, or use another person's account without permission.
- Tamper with fuel measurements, receipts, delivery records, invoices, payment records, location data, or order status information.
8. Account Suspension and Termination
We may suspend, restrict, or terminate access to vayaSupa if we believe you have violated these terms, created risk for customers, drivers, the public, or vayaSupa, provided inaccurate information, engaged in fraud or abuse, failed verification, breached payment obligations, or acted unlawfully. You may stop using the service at any time, subject to completing or settling any outstanding orders, deliveries, payments, or obligations.
9. Data, Privacy, and Communications
We collect and use personal information according to our Privacy Policy. Depending on your role and features used, this may include identity details, contact details, addresses, driver and vehicle information, order history, payment records, app activity, device information, documents, and location data. Location data may be used for address selection, delivery assignment, route support, tracking, safety, fraud prevention, and service improvement.
By using vayaSupa, you agree that we may contact you by app notification, SMS, WhatsApp, phone, email, or other reasonable channels for account, order, delivery, payment, safety, support, verification, legal, or service-related messages.
10. Intellectual Property
vayaSupa's name, branding, software, website, app design, content, icons, workflows, data structures, and related materials are owned by vayaSupa or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or use our intellectual property without written permission.
11. Third-Party Services
vayaSupa may rely on third-party services for payments, maps, analytics, communications, hosting, storage, authentication, app distribution, and other platform functions. These providers may have their own terms and policies. We are not responsible for third-party services outside our control, but we select service providers to support the operation, safety, and reliability of vayaSupa.
12. Disclaimers and Liability
vayaSupa is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, error-free operation, exact delivery times, continuous driver availability, uninterrupted payment partner availability, or that every order can be accepted or completed.
To the maximum extent permitted by law, vayaSupa is not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages. Nothing in these terms limits liability that cannot be limited under South African law.
13. Indemnity
You agree to indemnify and hold vayaSupa, its directors, employees, contractors, partners, and service providers harmless from claims, losses, liabilities, damages, penalties, costs, and expenses arising from your breach of these terms, misuse of the service, unlawful conduct, negligence, unsafe behavior, inaccurate information, or violation of another person's rights.
14. Governing Law and Disputes
These terms are governed by the laws of the Republic of South Africa. Please contact us first so we can try to resolve any dispute informally. If a dispute cannot be resolved through support, it may be referred to the courts or another dispute resolution process available under South African law.
15. Changes to These Terms
We may update these terms from time to time. Updated terms may be posted on the website, linked in the app, or sent through reasonable communication channels. Continued use of vayaSupa after changes become effective means you accept the updated terms.
